Terms & Conditions
These Terms & Conditions explain the agreement between you ("the Client") and Websites By Stu ("we", "us" or "our") when you engage us to design, develop or maintain your website.
We've kept these terms simple and easy to read, but they form part of every accepted quotation or proposal.
1. Scope of Work
We'll build the website outlined in your accepted quotation or proposal.
If additional features, revisions or functionality are requested outside the agreed scope, we'll provide a separate quotation before any extra work begins.
2. Project Timeline
Project timeframes depend on receiving all required content, images, approvals and feedback from you.
Delays in providing information may extend the project completion date.
3. Client Responsibilities
The Client agrees to provide:
- Website content
- Images and logos
- Branding material
- Product information (where applicable)
- Timely feedback and approvals
Any content supplied by the Client remains the Client's responsibility.
4. Payments
A deposit is required before work commences.
The remaining balance is payable before the website is published unless otherwise agreed in writing.
Where a Websites By Stu payment plan has been approved, payments must be made according to the agreed schedule.
5. Ownership
Once all outstanding invoices have been paid in full, ownership of the completed website transfers to the Client.
Until payment has been received in full, all intellectual property remains the property of Websites By Stu.
6. Changes During Development
Reasonable revisions are included during the design process.
Major design changes or additional functionality requested after approval may incur additional charges.
We'll always discuss any additional costs before proceeding.
7. Website Warranty
Every new website includes our 30-Day No Lemons Guarantee.
If something we've built doesn't perform as agreed due to our workmanship, we'll fix it at no additional cost during the first 30 days after launch.
This warranty does not cover:
- Third-party software
- Hosting issues outside our control
- Changes made by others after launch
- New features requested after launch
8. Hosting & Domain Names
Unless otherwise stated, website hosting and domain name registrations are billed separately.
If Websites By Stu manages your hosting, ongoing hosting fees apply.
9. Ongoing Support
We're here to support you after launch.
Website maintenance, updates and additional development are available under separate support agreements or hourly rates unless included in your proposal.
10. Third-Party Services
Some websites may integrate with third-party services such as payment gateways, shipping providers, Google services, social media platforms, plugins or other external software.
Where these services are included as part of your project, Websites By Stu will configure and integrate them as agreed. However, we cannot guarantee the ongoing availability, pricing or functionality of any third-party service, as these are controlled by their respective providers.
Some third-party services, plugins, software licences or API integrations may require additional subscription fees, licence fees or usage charges. Unless otherwise stated in your quotation, these costs are the responsibility of the Client.
Any ongoing subscription or renewal costs for third-party services are not included in the website development fee unless specifically stated in your quotation.
Websites By Stu will always discuss any additional third-party costs with you before they are implemented. No third-party services, subscriptions or licences will be purchased on your behalf without your approval.
11. Limitation of Liability
While we take every reasonable care in delivering your website, Websites By Stu is not liable for indirect loss, loss of business, loss of profits or data resulting from the use of the website.
Our total liability is limited to the fees paid for the project.
12. Acceptance
Payment of the project deposit or acceptance of our quotation confirms acceptance of these Terms & Conditions.
